Prior Information to Contracting

These general terms of contract, together with any Specific Terms that may be established, shall expressly govern the relationship between Mansolutely S.L., with Tax ID number B-76756485 and registered office at C/ Príncipe 12, 2ºB Madrid, (hereinafter the Administrator) and third parties (hereinafter "User") who purchase products offered through the website www.mansolutely.com.

These General Terms have been prepared in accordance with Law 34/2002 on Information Society Services and Electronic Commerce, Law 7/1998 on General Terms of Contract, and other relevant legal regulations.

By using the Website and/or acquiring any of its products, the User accepts, without reservations of any kind, each and every one of the General Terms of Contract, the General Terms of Use of the Website, as well as, where applicable, the Specific Terms that govern the purchase. By viewing this website or using it to place an order, you agree to these Terms and our Privacy Policy, so if you do not agree with all the Terms and the Privacy Policy, you should refrain from placing an order.

The Administrator informs that the procedures for purchasing its articles are those described in these general terms of contract, as well as those specific ones that are indicated on screen during browsing, so that the User declares to know and accept such procedures as necessary to access the products and services offered on the Website.

Any modification and/or correction of the data provided by Users during browsing should be made according to the instructions included on the Website.

The User may access, print, download and save the General Terms of Contract at any time. These Terms will be permanently accessible on the Website through the General Terms link on www.mansolutely.com.

Products offered. Purchasing System

The clauses listed below make up the "General Terms of Contract", with the purpose of regulating the acquisition, through www.mansolutely.com, by users, of the products offered by the ADMINISTRATOR in its online store. The User will need to consult, register and accept these terms before making the online purchase, understanding that access to the store as well as the purchase of any of the products offered implies acceptance of these General Terms of Contract. Specifically, for the acquisition of the products offered through the website www.mansolutely.com, users who proceed to register must be over eighteen (18) years of age and must complete the instructions that appear in these General Terms of Contract, which will require executing the following instructions, as well as any others that are included in the different screens of the Website:

(a) Complete the electronic form that appears on the screen according to the purpose, following the instructions indicated therein.

(b) Click on the Order Confirmation icon/button.

On the other hand, the Administrator reserves the right to stop providing the acquisition, at any time and without prior notice, of any of the products offered on the Website.

The information that appears on this Site is current as of the date of its last update. The ADMINISTRATOR reserves the right to decide at any time, the Products that are contained and offered to Users through the Website, so that it may update, modify or delete the content and elements that make up the Site, without the need to communicate it previously, when it deems appropriate. Consequently, the ADMINISTRATOR may at any time add new products to those included on the Website, it being understood, unless otherwise provided, that such new products will be governed by the provisions of the General Terms in force at that time.

The Username and Password provided by the User to the Administrator are identifying elements and enablers to access the products and services of the Website, and are personal and non-transferable.

The Administrator reserves the right to cancel the Username and password, and therefore access to the Website of those users who do not observe the Terms of Use of the Portal or the General Terms of Contract in force in each case.

To make a purchase, the user will send their order online through the shopping cart. The information that appears in the catalogs and price lists is only indicative. The ADMINISTRATOR may modify them, without prior notice and at any time, according to market circumstances, although the ADMINISTRATOR guarantees that the prices that will be applied at all times are those current on the Website at the time of confirming the order. In case of price modification, orders already in progress will not be affected. Special offers, promotions or discounts will be valid until the indicated date or until stock runs out.

The Administrator offers through this page a selection of products marketed under the MANSOLUTELY brand. Each of the articles offered on this Website is accompanied by the following information:

Regarding the color of the garments that appears on screen, you are warned that it may be subject to variations depending on your computer screen, and for this reason we cannot guarantee that the colors that appear are faithfully adjusted to reality. Without prejudice to the above, the ADMINISTRATOR makes every effort to ensure that the colors that appear on screen are shown as close as possible to reality.

The manufacturing of the products that appear on this page is carried out in Spain, China, Italy and Portugal under the MANSOLUTELY brand, with the strategic manufacturing partners of each country being authorized by the Administrator to carry out this activity.

Purchase Procedure

To acquire the desired articles, you must select them and add them to the shopping cart by clicking on the corresponding icon. The cart will contain the reference of the selected article, and its price, indicating the corresponding taxes. To place the order, you must register, for which you will be asked for your necessary personal data, which will be incorporated into our database in order to be able to process said order as well as facilitate the making of new purchases on www.mansolutely.com. Likewise, you will be able to access your personal data and the information of all your orders. It is important that you indicate these data with the greatest accuracy, to avoid confusion or incidents in the shipment of the acquired articles. If you so request, in addition, you will receive by mail and/or e-mail information or newsletters related to this portal. Once the order has been formalized by completing the data related to it, and before its shipment, a summary will be presented identifying the acquired article, its total price (transport and taxes included) and the shipping data. Once the transaction has been confirmed, you will be informed through the website itself of your order number in order to enable you to track it at all times.

Likewise, an email message will be sent, with a description of the order and the personal data that have been communicated. In case of not receiving it, it is advisable to contact the ADMINISTRATOR by email at info@mansolutely.com

Form, Costs and Delivery Period

The ADMINISTRATOR sends orders to its customers through different nationally and internationally renowned express transport companies. The delivery date at the User's address depends on the product chosen and the shipping area, with a delivery period of 5 weeks for made-to-measure products, and 5 days for standard-sized products. For orders with delivery address outside Spain, between 1 and 2 working days will be added to the delivery period described above. Shipping costs appear on the Website when placing the order and prior to its confirmation.

Delivery is considered effective from the moment the product is made available to the Customer by the carrier and the recipient signs the receipt of delivery. It is the recipient's responsibility to verify the products upon receipt and present all reservations and claims that may be justified.

The ADMINISTRATOR guarantees the delivery period except in situations, events or circumstances that are beyond our control (customer is not available, adverse weather conditions, errors in shipping information, legal procedures, etc.). Shipping is free for orders within the European Union. For shipments outside the EU, a flat rate will be applied depending on the destination country. Once the shipping address has been entered, the transport costs will be calculated, informing you before formalizing the order.

Buyer's Rights & Returns Policy

The garment will be reshipped if:

The chosen fabric does not match that of the received article (differences in tonality caused by the effect of the monitor are not considered at this point.

The configuration of the suit does not correspond to that of the order.

It should be taken into account that the measurements introduced in the profile are body measurements and, depending on the characteristics of the garment, it will take a certain size different from the body measurements, so direct comparison between the size of the garment and the profile measurement will not be considered as a valid argument as an indication of an error. Everything related to claims about measurements is governed according to the following section called Adjustments.

Adjustments

The ADMINISTRATOR will offer to compensate the User for the necessary expenses for the final adjustments of the acquired garment provided that the User meets the following requirements:

a) The adjustment is performed by a professional tailor

b) An incident has been raised within the following 15 days of receipt of the garment

c) In the case of a measurement adjustment, having modified their measurement profile

d) Must send the scanned invoice to info@mansolutely.com

The ADMINISTRATOR commits to return the expenses incurred by the adjustments within a period of 15 days, if the above requirements have been correctly fulfilled and with a maximum limit per garment of:

Suits: 40€
Blazers: 25€
Waistcoat: 15€
Trousers: 15€
Shirt: 15€

In those cases where the garment cannot be adjusted, the User must raise a "Remake" incident so that the ADMINISTRATOR can assess whether the Adjustment is not possible.

In case the ADMINISTRATOR accepts the "Remake" incident, the User must send the garment subject to the "Remake" to our offices:

The User must bear the shipping costs of the product.

The ADMINISTRATOR reserves the right not to accept the product sent by the User in case it has been used or some adjustment has been made. The replaced garment will be received by the User in the same period as a regular order, after acceptance of the incident by the ADMINISTRATOR.

Payment Terms

The products acquired through this portal will be paid for by the User on the Website, through credit card, through the secure PayPal payment gateway system or by bank transfer. The User must pay the full amount of the acquired products, so that the order will be valid once the bank confirmation of the payment made has been received. For payments with credit or debit card, the charge will be made online, that is, in real time, through the payment gateway of the corresponding financial entity, once it has been verified that the communicated data is correct. Credit cards will be subject to the corresponding checks and authorizations by the issuing entity, so that, if said entity does not authorize payment, the ADMINISTRATOR is not responsible for the consequences derived from the delay in delivery or the impossibility of the same.

User Obligations

The User agrees to accept all the provisions and conditions contained in these General Terms of Contract as well as to keep their personal access keys to the portal confidential and with the utmost diligence.

Likewise, they commit at all times to provide truthful information about the data requested in the user registration forms or order placement, and to keep them updated at all times.

The User commits to enable the delivery of the requested order by providing a delivery address where said order can be delivered. The Administrator will have no responsibility for the delay or impossibility of delivery of the order requested by the User, derived from the breach by the User of this obligation to facilitate said delivery.

Applicable Legislation and Competent Jurisdiction

Purchases made through the website www.mansolutely.com are subject to Spanish legislation.

In the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, the Courts and Tribunals that, where appropriate, will hear the matter, will be those provided by the applicable legal regulations on matters of competent jurisdiction, which attends, in the case of consumers, to the place of fulfillment of the obligation or to the domicile of the buying party. In the event that the buying party has their domicile outside Spain, both parties submit, with express waiver to any other jurisdiction, to the Courts and Tribunals of Madrid (Spain).
